Payment Gateway Terms and Conditions for Vicharta Samuday Samarthan Manch

1. Introduction

1.1. These Terms and Conditions (“Agreement”) govern the use of the payment gateway services (“Services”) provided by Vicharta Samuday Samarthan Manch hereinafter VSSM, a non-profit organization, for the purpose of processing donations and other financial transactions.

1.2. By accessing or using the payment gateway for donations, you (“Donor,” “you,” or “your”) agree to comply with and be bound by these Terms and Conditions.

1.3. If you do not agree to these Terms and Conditions, you must not use our Services.

1.4. This payment gateway is provided by [Razorpay Payment Gateway] on behalf of VSSM, and payments are processed according to the terms set forth by both parties.

2. Purpose of the Service

2.1. The Services enable individuals, corporations, and other entities to make monetary contributions to VSSM for charitable purposes through various online payment methods, including but not limited to credit cards, debit cards, bank transfers, UPIs and e-wallets.

2.2. Donations processed through the payment gateway will be used exclusively for the purpose outlined in the VSSM’s Trust Deed, as well as in any specific fundraising campaign you support.

2.3. We may also use the funds for operational costs, including administrative expenses, unless otherwise specified in the campaign description.

3. Eligibility

3.1. By using this payment gateway, you confirm that you are legally authorized to make donations and are using a valid payment method.

3.2. You must be at least 18 years old or have parental consent to make donations. If you are making a donation on behalf of an organization, you confirm that you have the legal authority to do so.

4. Donation Process

4.1. To make a donation, you must provide accurate and complete payment information, including your name, contact details, PAN/Aadhar Details and payment card or account details.

4.2. The payment gateway processes payments in real-time. Once a donation is made, you will receive an electronic receipt confirming your donation.

4.3. All donations made through our platform are final and non-refundable, except in cases where the donation was processed in error or if the campaign has been cancelled.

5. Fees and Charges

5.1. VSSM strives to keep transaction fees to a minimum. However, some payments may incur processing fees charged by our payment gateway provider. These fees will be transparently disclosed during the donation process.

5.2. Any additional charges for currency conversion or international transaction fees may also apply, depending on the donor’s payment method or geographical location.

5.3. You are responsible for ensuring that the funds donated are the full and accurate amount, including any applicable fees.

6. Refunds and Cancellations

6.1. Due to the charitable nature of donations, refunds are not typically provided. However, if an error occurred during the donation process, please contact us at vssmgujarat@gmail.com within 07 days for a review of your case.

6.2. If a fundraising campaign is cancelled or if your donation is found to be in error, you may request a refund, subject to our review and approval.

7. Donor Information and Privacy

7.1. We value your privacy and are committed to safeguarding your personal data in compliance with applicable privacy laws, including [80G, FCRA, or other relevant laws].

7.2. Personal information collected during the donation process will be used only for the purposes of processing donations, communicating with donors, and providing receipts. We will never sell, rent, or share your personal information with third parties, except as required by law.

8. Use of the Payment Gateway

8.1. By using our payment gateway, you agree not to engage in any unlawful activities or fraudulent behaviour, including the use of stolen payment methods or the donation of funds obtained through illegal means.

8.2. You agree to provide accurate, up-to-date information during the donation process and to notify us promptly of any changes to your details.

8.3. VSSM reserves the right to refuse donations from individuals or organizations found to be involved in illegal or unethical activities, or from jurisdictions subject to sanctions or restrictions.

9. Tax Deductions and Receipts

9.1. Donations given to VSSM is exempted u/s 80(G) of the Income Tax Act, 1961 vide Approval No. AABTV2421MF20214 valid up to 31/03/2026. Please consult with a tax advisor to determine whether your donation qualifies for tax deduction benefits.

9.2. After making a donation, you will receive an electronic receipt for your records. This receipt includes the donation amount and the date of the transaction. For tax purposes, please retain this receipt.

10. Limitation of Liability

10.1. VSSM and its payment gateway provider are not responsible for any errors, interruptions, or issues with the payment gateway service, including but not limited to technical problems, transaction failures, or delays.

10.2. In no event shall VSSM or the payment gateway provider be liable for any direct, indirect, incidental, or consequential damages arising from the use of the payment gateway.

11. Termination and Suspension

11.1. VSSM reserves the right to suspend or terminate your use of the payment gateway if we suspect fraudulent activity, violations of these Terms and Conditions, or other illegal behaviour.

11.2. You may contact us to stop future donations or request the removal of your account from our system.

12. Modifications to These Terms

12.1. VSSM may modify or update these Terms and Conditions at any time. Any changes will be posted on our website and will take effect immediately upon posting.

12.2. We encourage you to review these Terms periodically to stay informed of any updates.

13. Governing Law

13.1. These Terms and Conditions are governed by the laws of India Jurisdiction, and any disputes related to these Terms shall be resolved in the courts of Ahmedabad.
